And tonight, caught on tape, McSteamy`s anatomy. That`s right. Tonight, SHOWBIZ TONIGHT is revealing the explosive naked taped threesome involving "Grey`s Anatomy" star Eric Dane who plays a sex-crazed doctor on the show, and is known by the nickname McSteamy.
But wait, it gets even better. You see, Dane apparently taped much of it himself and participating were his famous wife and another young woman who, shall we say, does not have the most pristine of reputations which is why this is all making big news right now.
(BEGIN VIDEOTAPE)
(voice-over): If you`re known as McSteamy, what better way to live up to your name? Well, it seems the "Grey`s Anatomy" star Eric Dane is doing just that in this very nude three-way tape.
ERIC DANE, ACTOR: Hi, girls.
UNIDENTIFIED MALE: Hi, boy.
DANE: How are you doing?
DIAZ: Fittingly, Dane`s character on "Grey`s" is nicknamed McSteamy because, well.
CHANDRA WILSON, ACTRESS (as Dr. Miranda Bailey): This man is a whore, has always been a whore, will probably always be a whore.
DIAZ: Now, Dane is living up to his character`s reputation in this hot, self-made video that features not one, but two naked women.
DANE: You`ve got to be two of the (EXPLETIVE DELETED) hottest girls this side Mulholland. And I`ve seen some hot girls before.
DIAZ: One is his wife of four years, actress Rebecca Gayheart, best known for her Noxema commercials in the `90s. Her skin does look terrific. And the other woman, one-time Playboy playmate, Kari Ann Peniche.
MIKE WALTERS, TMZ: They took a bath, Eric filmed. The fact is that everyone got naked, took a bath, took a shower, hung out in bed and just sort of had a friendly party - naked party, I guess.
DIAZ: Whatever happened to playing Pictionary? Anyway, SHOWBIZ TONIGHT can tell you in the days since this tape leaked, this video has become the buzz of the Internet. But whatever you do, do not call this a sex tape.
UNIDENTIFIED MALE REPORTER: So can you tell us anything about the video?
DIAZ: Girl number two, though, Kari Ann, tells TMZ no one actually had sex during this party.
QUESTION: There were no sexual encounters, right?
KARI ANN PENICHE, FORMER MISS UNITED STATES TEEN: We were just having fun.
DIAZ: And in a statement to SHOWBIZ TONIGHT, Dane and Gayheart`s attorneys says, quote, "Although the participants are nude, the tape is not a `sex tape.`"
Well, now that we know that it isn`t a sex tape, the big question is, how did this video of McSteamy and his wife`s nude sex romp end up online?
WALTERS: We`re told that this tape was actually on a computer at Kari Ann`s house.
DIAZ: TMZ`s Mike Walters tells SHOWBIZ TONIGHT that Kari Ann is blaming country music star Mindy McCready who was her former roommate and co-star on VH1`s reality show, "Celebrity Rehab."
WALTERS: We`re told that that is what Kari Ann believes has happened with this tape - is that it came from Mindy and she believes she is responsible.
DIAZ: But no matter where the McSteamy sex tape - I mean nude tape came from, one thing is certain, McSteamy`s attorneys are trying to McSquash it.
WALTERS: They are upset and they`ve said they`re going to sue. And they`re going to go after anyone who publishes this tape.
DIAZ: Dane and Gayheart attorney tells SHOWBIZ TONIGHT, quote, "This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public. If anyone exploits the tape, they will be violating my clients` rights and will be exposed to significant liability."
But maybe there`s a simpler solution.
WALTERS: Guess what? Why don`t they just stop taping themselves having sex or naked?
DIAZ: And that brings us to this SHOWBIZ TONIGHT public service announcement - it`s a cruel epidemic that`s sweeping Hollywood. From big- time rock stars to Golden Globe-winning actors, and party-going starlets with no visible talent. The list of stars victimized by leaks of sex and/or nude images just keeps getting longer and longer with no end in sight.
WALTERS: It seems they never learn their lesson and that this just keeps happening over and over and over.
DIAZ: So stars, we`ve said it before and we`ll say it again - please, please, please, never record or photograph yourself having nude fun in any shape or form.
DANE: You`ve got to be two of the (EXPLETIVE DELETED) hottest this side of Mulholland.
DIAZ: And as Eric Dane and Rebecca Gayheart are learning the hard way, it will get out. This has been a SHOWBIZ TONIGHT public service announcement.

The more you know. As for that suggestion by Kari Ann that Mindy McCready may have had a hand in leaking the tape, SHOWBIZ TONIGHT reached out to McCready, but she did not respond as of show time. Well, since the nude trio didn`t get our SHOWBIZ TONIGHT how-to-avoid-a-sex-tape memo, this becomes Hollywood sex scandal number - you know, who`s even counting anymore?
With me now here in Hollywood is Lisa Bloom, who is a legal analyst for CNN. And in New York tonight, it`s Ben Widdicombe who is the celebrity editor for StyleList.com.
Now, Eric Dane and Rebecca Gayheart have been in Hollywood a long time. So they must know the golden rule - if you make a tape like this, it is going to get out without fail.
Lisa, does this boggle your mind that, once again, we have not one, but two stars, Eric and Rebecca, caught with their pants down, literally?
LISA BLOOM, CNN LEGAL ANALYST: You know, they had to know. It makes you wonder - did they secretly really want it to get out? I mean, they gave it to the other woman. She had it on her computer. And a fourth person got involved getting it.
Look, these are people who are not shy in front of a camera. They`re both drop-dead gorgeous. They drop their clothes. They had pictures taken. They took videos of themselves - her in the bath with the other woman. I mean, it doesn`t surprise me and I don`t think they probably really mind it all that much.
DIAZ: Well, Ben, I know you watched this for journalistic purposes. What were you thinking when you heard about this?
BEN WIDDICOMBE, CELEBRITY EDITOR, "STYLELIST.COM": Well, even though, you know, there`s no sex on the tape, I think the problem the participants have is it`s just sleazy. It`s very distasteful to watch over and over and over again.
But you know, the bigger problem that I think they`re going to have from this is there is some drug talk on the tape. And you know, I think that people have certain standards about sex. But you know, drugs are a different matter entirely.
So I think that that is going to be what comes back and bites these people on their perfectly formed Hollywood butts.
DIAZ: And Ben, I`m listening to you that make sure that you`re not calling this a sex tape because it is not a sex tape. Why? Well, because the attorney representing Eric and Rebecca says so.
In the best celebrity crisis statement ever, he tells SHOWBIZ TONIGHT, quote, "This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public. Although the participants are nude, the tape is not a `sex tape.` It is a private tape made for only my clients` personal use, and nobody has the right to exploit it."
I mean, Lisa, come on, does it really make a difference?
BLOOM: No, look, you can`t be a big star in Hollywood anymore unless you had a sex tape, I think. I mean, it`s become a prerequisite. You know, maybe my career would really blast off if - never mind. Never mind.
But these attorneys, I think, are making it worse. They should just drop it. It really doesn`t matter if somebody calls it a sex tape or non- sex sex tape or just an erotic, steamy nude tape. We`re all talking about it and we`re talking about it more maybe because of the attorney`s statement.
DIAZ: Well, our SHOWBIZ TONIGHT Facebook fans are having a field day with this McSteamy naked non-sex tape. Check this out. Jahmel T. writes on our Facebook wall, "Sex tapes and pics don`t have the same impact they sued to. Everybody`s doing it. No pun intended."
Talo writes, "It`s just them hanging out in the nude. No big deal!"
Ben, is it really no big deal that the star of one of the biggest shows on TV makes a tape like this? Or does he get a pass because he`s McSteamy?
WIDDICOMBE: Well, I think the tape certainly is not as shocking as some of the other tapes we`ve seen, although I`m fascinated by what his attorney refers to as private use. What does that mean - the "Grey`s Anatomy" holiday they`re bringing on? What are they going to do with this tape?
So it`s not so bad. I mean, there is no sex in it, which means it`s a bit of a dud in terms of what other tapes we`ve seen. You know, so I expect a big opening weekend for the tape, but probably not much of a DVD backend.
DIAZ: Let`s not forget Eric Dane, by the way, got his McSteamy nickname on "Grey`s Anatomy" after famously wearing nothing more than a towel coming out of the shower. He`s totally sex-crazed on the show. And women love him.
Lisa, will this tape become the first celebrity tape in history that as many women will want to see than men?
BLOOM: It very well might. You`re right. He is hot, there`s no doubt about it. And this is a tape that he made, he directed. He participates in it. It may be something that women want to see.
And it doesn`t look like it`s sleazy or slimy like some of the other tapes that we`ve heard about. You know, it was consensual between three people who seemed to enjoy each other`s company. So maybe my gender will enjoy it a little bit.
DIAZ: Well, Ben, I`ll hold off on your comments whether you`re going to watch this again from later. Lisa Bloom, Ben Widdicombe, thanks for now. The "Showbiz on Call" phone lines have been out of control with people calling in nonstop about dog killer and disgraced NFL star Michael Vick. We`ve got a call into our "Showbiz on Call" from Debbie in New York who thinks Vick has learned his lesson.

Robin Wright Penn is filing for divorce from Sean Penn again. The reason, according to court documents - irreconcilable differences. The couple has been married for about 13 years. And this is, get this, the third time they`ve filed divorce papers.
In a brand-new interview, Robin tells "More" magazine, quote, "I hit that crossroad a while ago. I know what I don`t want. I, we, have to amazing children we raised together." The court papers also say Sean and Robin have already split up their property.
There is an all-out war of words on the SHOWBIZ TONIGHT Facebook page over Michael Vick. We asked if he should be forgiven after serving time for killing dogs.
Brooke S. says she won`t forgive Vick. She writes, "No, he shouldn`t be forgiven. Do you think those dogs forgive him for what he`s done? He served his jail time, but now, he has to live with the fact that he used helpless animals for his own sick games. No one will forget that."
But Michelle F. says Vick paid the price. She writes, "Like him or not - he paid his debt to society and has the right to live his life. I do hope he has learned a lesson and will take this second chance to do the "right" things.

All right. I want to begin with this brand-new explosive nude tape of Eric Dane. Lisa, do you think he has anything to be embarrassed about? Or given his role on "Grey`s Anatomy" as, you know, the go-to sex guy, this can really only - this can help his image, you know.
BLOOM: Right. Apparently, on "Grey`s Anatomy," he had to have this little towel taped on just so that when he had his nude scene and the towel just barely covered what it needed to cover, it stayed on.
I mean, this is a guy who`s made a career out of being sexy - look, there he is - out of being half naked, out of being practically naked. So he goes all the way and he is naked on this video. I don`t think most people think that`s a big deal.
DIAZ: We need to not show video of him while she`s talking, by the way. Ben, do you think Eric Dane has a lot to gain from this?
WIDDICOMBE: Oh, sure. I think anytime people are talking about Eric Dane, they`re going to be more curious about the show. The big disappointment is that he seems to have let himself go since that famous scene where he appears on "Grey`s Anatomy" in the towel. I thought he was looking a little bit out of shape in the non-sex tape. So I think maybe it`s time to get back to the gym, Eric.
DIAZ: Thanks for that analysis, Ben. ABC, which carries "Grey`s Anatomy," is not commenting on the video. But Eric Dane`s lawyer, Marty Singer, is. And he says the tape is not a sex tape.
He says, quote, "This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public. Although the participants are nude, the tape is not a `sex tape.` It is a private tape made for only my clients` personal use, and nobody has the right to exploit it."
Lisa, do you think anybody is looking to exploit this tape? It appears to be pretty harmless.
BLOOM: Yes, I would say to the lawyer`s statement, wa, wa, wa, wa like in the Charlie Brown cartoon. I mean, from a legal point of view, you have no reasonable expectation of privacy when you bring a third party in. And from just a commonsense point of view, when you give a video like this to a friend, what do you think is going to happen?
She`s going to show it to people. They`re going to grab it a moment of weakness. It`s going to go online has it has many, many times. So I think these lawyers look a little foolish with that statement.
DIAZ: This is certainly not the first scandal for "Grey`s Anatomy." Let`s roll out the SHOWBIZ news line. In October of 2006, there was Isaiah Washington`s anti-gay slur involving co-star T.R. Knight. In June of 2008, there was Katherine Heigl`s back-handed slap at the writers of the show over Emmy consideration.
And now, the Eric Dane three-way nude romp. Ben, those other scandals arguably hurt the show. But given McSteamy`s image, could this help the show?
WIDDICOMBE: You know, I don`t think either of those scandals really did hurt the show too much. Anytime that people are talking about the show or we`re discussing it here tonight - I think it basically promotes curiosity about the show.
People want to tune in to see what it`s like. This won`t hurt the show. I think this is very survivable for the young actors. There are much worse sex tapes out there that other people survived. I think they`ll get through this.
DIAZ: Well, our SHOWBIZ TONIGHT Facebook page has been burning up all day about how this steamy new threesome video could affect the show.
Take a look at Arianne D. writes on our wall, quote, "I already love the show, so video or not, I`m watching."
Lisa, do you think after people feel the same way that Arianne feels?
BLOOM: Yes, the show might lose viewers simply because they`re online trying to find the sex tape and watching it over and over and over again. But most people watch the show because they want to catch a little glimpse of this guy when his shirt`s off or when he just has that little towel on, so I don`t think it`s going to hurt him at all.
DIAZ: Yes. If he was, like, helping an old lady across the street, you`d go, how out of character. I mean, that`s the character he plays.
And here`s what Judy P. writes on SHOWBIZ TONIGHT Facebook wall, quote, "The show can stand on its own merit. I watch it for McDreamy, too."
Ben, do you think more people will watch "Grey`s Anatomy" because of this?
WIDDICOMBE: Oh, sure. And I think if McDreamy wants to stay in the game, he better get on releasing his own non-sex tape pretty pronto. Otherwise, he might find himself behind the (INAUDIBLE) the next time the contract negotiations come around.
DIAZ: He wasn`t behind anything in this video, by the way. It`s quite out there for everyone to see. Let`s move on, OK, to the next story still making big news tonight.

DIAZ: You`ve got to see this. In our SHOWBIZ TONIGHT question of the day, we asked viewers on air and online, "Michael Vick: Should he be forgiven?" Take a look at these results. It was split right down the middle - 50 percent said yes, he should be forgiven. The other 50 percent said no.
After years of polling, this is unprecedented for SHOWBIZ TONIGHT - a 50-50 split on a question of the day. Lisa, are you surprised at the results?
BLOOM: I`m not, because I find this a very difficult issue myself. I`m a lifelong animal rights activist, vegetarian all my life. And I own a pit bull so I hate what he did. But I also believe ex-offenders should be given a second chance.
I think he is genuinely remorseful. And he may do something good getting out there talking to kids about animals. He may now understand why people feel so strongly about animals. So I do want to give people a second chance. I think most people feel that way. I`m torn just like the SHOWBIZ TONIGHT viewers.
DIAZ: Our "Showbiz on Call" phone lines have been flooded with calls about this apology. Listen to what Allie from Indiana said about it.

DIAZ: So clearly, Allie falls within the 50 percent of those who think that Vick should be forgiven. Ben, are you surprised this split was right down the middle?
WIDDICOMBE: No. Because I think - like Lisa said, I mean, I`m split myself. Intellectually, I think he deserves a second chance and I believe that redemption is possible. But emotionally, I haven`t forgiven him and I don`t want to see him playing football again.
And I certainly don`t want to see him any PSAs for the Humane Society which we`ve been talking about. Because I think I`d turn the television off. I`m just not ready to forget what he did to those poor animals.

DIAZ: Incredibly, it has been nearly two months since Michael Jackson`s shocking death and the cause of death still hasn`t been officially announced. But today, finally, we know where he will be laid to rest. The burial plans were just announced today.
Jackson will be buried August 29th at Forest Lawn Memorial Park in Glendale, California. The private ceremony will be limited to family and close friends. August 29th would have been Jackson`s 51st birthday.

And on the very same day we learned when Michael Jackson will be laid to rest comes this blockbuster - an unexpected, emotional video from the man smack dab in the crosshairs of the investigation, Dr. Conrad Murray.
Michael Jackson`s personal physician spoke out publicly today for the very first time and gives the world a glimpse into his troubled and isolated life. Just wait until you hear his emotional message to his friends and family.
Plus, will Michael Jackson`s family finally get some peace after laying Michael to rest? La Toya Jackson speaks out for the very first time. In a brand-new interview, she reveals how the Jackson family is really doing.
Joining me tonight, once again, Lisa Bloom, who is our CNN legal analyst. And tonight in New York, April Woodard, who is an entertainment journalist.
Dr. Conrad Murray has finally broken his silence. For months now, he`s been the number one target in the Michael Jackson investigation. His home and offices have been raided, documents confiscated, his life scrutinized. Investigators are still trying to determine whether Dr. Murray gave Jackson a dose of the dangerous anesthetic propofol and left him unattended.
Well, late today, Dr. Murray released an emotional video to friends and family on YouTube.

MURRAY: All of my patients and friends who have sent such kind E-mails, letters and messages to let me know of your support and prayers for me and my family. Because of all that is going on, I`m afraid to return phone calls or use my E-mail. Therefore, I recorded this video to let all of you know that I have been receiving your messages.

DIAZ: Lisa, why did Dr. Murray do this video? Why now?
BLOOM: I don`t know anyone who`s been supporting Dr. Murray. I`m glad to hear that his friends and family have been reaching out to him.
But certainly, the Jackson family and the authorities are holding him accountable for Michael Jackson`s death, or at least, appearing that they`re going strongly in that direction.
I understand this video was made by the publicist for Dr. Murray`s attorney, if you can follow all those steps. And I think this is an attempt to get out there a positive message by Dr. Murray, make him look like a nice guy, make it look like he has a lot of people supporting him in the hopes he doesn`t get arrested very, very soon.
DIAZ: Well, Lisa, it`s apparent in the video that this guy hasn`t gotten a whole heck of a lot of sleep. I mean, he`s glassy-eyed. And it really - it kind of sounds rehearsed. But he is pretty emotional. Check it out.

DIAZ: April, does it seem to you that the strain of being suspect number one in Michael Jackson`s death is taking its toll?
APRIL WOODARD, ENTERTAINMENT JOURNALIST: Oh, absolutely. I mean, this man has got the burden of the world on his shoulders. After all, most of the people in the public believe that this is the man that is responsible for the death of the King of Pop.
And I just think that you can listen to his breathing, you can look in his eyes and see they`re glassy-eyed. I just believe that he`s concerned about his future. He`s concerned about the way people are looking at him.
And I think the other interesting thing that just happened is that Joe Jackson just said today in a report that he believes that Dr. Conrad Murray may be taking the whole entire burden of some of the responsibility of some other doctors.
So I think that`s an interesting point, too. And he is, basically, taking the responsibility of a bunch of work, a bunch of mishaps of other doctors.
DIAZ: Well, April, Dr. Murray doesn`t really mention the actual specifics of the case in his video. He doesn`t even mention Michael Jackson`s name. But he does say he told the truth. Watch this.

MURRAY: Please, don`t worry. As long as I keep God in my heart and you in my life, I will be fine. I have done all I could do. I told the truth, and I have faith the truth will prevail. God bless you and thank you.

DIAZ: Lisa, he says the truth will prevail. Do you see this as Dr. Murray`s way of letting people know he thinks he`s innocent?
BLOOM: Yes, I do. And of course, he doesn`t want to talk about any of the facts of the case. And his attorney`s said all along he`s come clean with law enforcement. I think he`s probably a little scared. You know, I can remember covering Michael Jackson`s trial in 2005. And I personally got death threats from some crazed fans, just from being a journalist covering the trial.
I`m sure this guy who`s at the center of this worldwide maelstrom about Michael Jackson`s death has really been taking a lot of slings and arrows from the public. We have to remember he is presumed innocent. He has not been arrested yet. He might never be arrested for all we know. And you can see what he`s going through - a very, very difficult time.
DIAZ: Well, that`s not the only big news on the Jackson front. Let`s move on to other big news. Michael Jackson`s sister La Toya sits down and speaks out with my colleagues at "Extra."
It`s her very first sit-down interview since Michael`s death. La Toya finally reveals just how the Jackson family is really doing behind the scenes. Watch this.

DIAZ: April, except for her brief claim that she thinks Michael was murdered, La Toya`s been silent until that interview with "Extra." Why speak out now?
WOODARD: You know, whenever she speaks out, I`m very skeptical. This is one of the Jacksons, including Joe, that I`m very skeptical whenever she speaks out.
But I think on the one hand, she wants people to know her family is OK because there are generally a lot of people who are concerned about the Jackson family, who care how they`re doing, what`s going on.
But on the other hand, I feel like it`s somewhat self-serving. I think it is to, you know, do somewhat of a self-promotion. And I have to be somewhat skeptical of why she`s coming out now.
DIAZ: Lisa, we`ve got about 15 seconds - do you agree with her decision not to be on "Dancing with the Stars"?
BLOOM: Sure, absolutely. I mean, she`s got to be going through a tough time right now. Every word that comes out of her mouth or any of the Jackson family members is, I guess, so carefully scrutinized. This is a time for grieving and repairing the family and for the family to be together.

The funny thing is, Brad just said on Bill Maher`s show that he used to toke it up quite a bit but doesn`t anymore because he`s a dad. I don`t know. Maybe, he had some hash laying around for when company comes over, you know, like fine china.
